
Makadara Law Courts where RA was charged

A man who allegedly infected his wife with HIV is facing charges of deliberate transmission of the contagious virus in contravention of the sexual offenses (SO) Act of 2006 after failure to use protection during intercourse.
RA is accused of knowingly and intentionally infecting PO on diverse dates between October 2024 and August 2025 when he had sexual intercourse with her without protection, knowing he is HIV positive.
The suspect has also been charged with unlawfully assaulting and causing injuries to the complainant in contravention of section 251 of the Penal Code on August 27 during a domestic dispute.
The alleged offences were committed in Huruma JohnSaga area in Mathare Sub County, Nairobi where RA lived with PO since October.
He denied the charges before Chief Magistrate Beatrice Kimemia of Makadara law courts and pleaded for lenient bail and bond terms through an advocate who told the court to consider that RA was on medication.
The office of Director of Public Prosecution understands that RA knew he had HIV and therefore had the responsibility to protect PO from the virus but went on to deliberately infect her.
Police investigations established that PO had insisted that they use protection but RA claimed it was late at night and all shops were closed therefore it was not possible to buy condoms but promised that they could proceed for HIV screening thereafter if she doubted his status.
He never made his promise true and avoided the subject any time PO asked about the testing.
The relationship went on and PO got pregnant, and delivered a child.
She later discovered that she had little rushes on her armpits and shared with RA who confirmed that she had similar rashes and pledged to get herbal products to cure the same.
PO later went to hospital as the pain on the rashes persisted and was told to return with her husband to test for HIV together. RA allegedly became violent and assaulted PO after she told him what medics had told her.
PA reported the matter at Huruma police station vide Occurrence Book number (OB) 24/28/8/2025 and the suspect was traced and arrested after investigations.
The suspect was released on a cash bail of Sh50, 000. The case will be mentioned on October 23, 2025 before hearing starts on February 25, 2026.
